article 7 and 52 grievance, info or experience getting job back?

Just want to get some input on the topic of wrongful termination. I was let go for job abandonment. To keep this short. I have a bad back. Doc. had me off work until further notice. Was getting treated, but then my insurance canceled my coverage. Fought with the insurance company for several months before they started to cover me again. This took about 7 months to play out. The time I was not covered my the insurance, I couldn't go to the doctor because I could not afford treatment. In that time period waiting I was let go.

The grievance has been filed. Just waiting on a hearing. Does anyone know the success of filing on these articles? Been a part timer of 14yrs. Hope I can get my job back. Any tips going into the hearing to help my cause? Thanks
 
I had an on the job injury of the same nature. But this last injury was not at work. So the insurance said it was a work comp. and they were not responsible. But after two appeal letters, the insurance company finaly approved my STD. I just did not get the approval soon enough. I was approved to July. I didn't find out until late Sept. Sort of complicated mess. I have a hearing soon. I just can't stand waiting 2 more weeks to find out what is going to happen. Just trying to prepare the best I can. THanks

Hard to say what will happen, if you were never released by a doctor as fit for duty I do not see how they can fire you. Unless they say that not going to the doctor was job abandonement? Why did you not at least go to the company doc to get a release or restrictions or some kind of ruling on your status? Or a clinic or something, most doctors offices will take a payment plan, even if its a dollor a week as long as you try.

My business agent Brian Rothman , for the St. Petersburg/Clearwater area, helped and guided me all the way. I'm am thankful that I never really needed the Union for 14yrs. But when I did they came through for me with flying colors.

Glad to see their there for some people. Looking at the deadlocked cases and all the cases we've lost nationally paints a different picture though.

Good to hear, some things do work out. Glad you got your job back, most of our union brothers and sister aren't as lucky.

You should have gotten a 72 hr notice before you were fired for job abandonment. You could have responded and avoided this whole mess.
 
It was all a mess. I was in contact with someone in HR. I was supposed to be on personal leave of absence in one letter. And another letter terminating me. But things worked out. Been back for 3 weeks now.

If anyone gets into a mess like this, it is so important to keep all your paper work from UPS. THere are so many different divisions of UPS that you deal with. UPS doesn't communicate very well within management. So keep your paperwork.

I WAS JUST TERMINATED FOR WHAT WAS CALLED " PROVEN DISHONESTY " I HAVE BEEN ON WORKERS COMPENSATION SINCE MID MAY OF 2009. I AM ALSO A VOLUNTEER FIREMAN , MID JULY WHILE DECLARED TOTALLY DISABLED ( a term ups is using very very strongly ) I WENT TO HANG OUT AT MY FIRE DEPARTMENTS ANNUAL CARNIVAL. WHILE AT THE CARNIVAL ONE OF UPS' OFF DUTY MOONLIGHTING COPS / PRIVATE INVESTIGATORS WAS CAUGHT VIDEO TAPING MY EVERY MOVE . WHILE OUT ON COMP I WENT TO SEE UPS' INSURANCE CARRIERS DOCTOR FOR AN INDEPENDANT MEDICAL EXAMINATION ( IME ) AND WAS GIVEN A VERBAL GO AHAEAD TO DO LIGHT WORK. I BEGAN TO ASK REPETETIVELY FOR LIGHT DUTY SO I CAN GET BACK INTO THE SWING OF THINGS . WELL ANYWAY THAT NEVER HAPPENED . I HAVE SINCE GONE FOR A WORKERS COMP HEARING , WHERE MY MEDICAL TREATMENT WAS CONTINUED BUT MY PAYMENTS HAVE NOT ( I WAS NOT IN THE ROOM DURING THE HEARING BUT OUT IN THE WAITING AREA ON THE PHONE WITH MY LAWYER WHILE HIS ASSOCIATE WAS IN THE HEARING ) . THROUGHOUT THIS 7 MONTH ORDEAL MY WORKERS COMP RATE WAS CUT TO A LESSER AMMOUNT DUE TO ME BEING PARTIALLY CLEARED , WITH UPS REFUSING ME WORK I NOW BECAME ENTITLED TO UNEMPLOYMENT ALSO. WELL UPS DECIDED TO FIGHT THAT ALSO ! NOW AFTER A UNEMPLOYMENT HEARING THAT WAS ADJOURNED FOR A LATER DATE BY THE MEDIATOR AND HOUNDING UPS HIGHER UP'S FOR WORK I FINALLY GET THE CALL 2 WEEKS AGO , HEY BE @ YOUR CENTER 9:30 ON THURSDAY FOR T.A.W.....GREAT , OR SO I THOUGHT ! I WALK IN TO AN ESCORT BY L.P. TO THESOUTH SIDE OF THE BUILDING WHERE MY CENTER AND MOST OFFICES ARE LOCATED . AND THANKFULLY MY BUISNESS AGENT WAS IN THE BUILDING FOR A DIFFERENT ISSUE . NOW I AM BROUGHT UPSTAIRS TO THE DIVISION MANAGERS OFFICE TO BE QUESTIONED ON AN ESTIMATED 50 QUESTIONS WELL IT WAS ACTALLY 5 BUT UPS THINKING THEY ARE DETECTIVES ASK THE SAME QUESTION 10 DIFFERENT WAYS FOR OVER AN HOUR ATEMPTING TO TRIP YOU UP. ANYWAY THEY WANTED MY JOB SO BAD THEY ACTUALLY BROUGHT IN THE REGIONAL EMPLOYEE RELATIONS MANAGER TO TAKE NOTES.......FINALLY I WAS TERMINATED FOR WHAT WAS CALLED AND NEVER PROVEN >>>>>>>>PROVEN DISHONESTY....I NOW AWAIT THE ARBITRATION DATE..

THEIR PROVEN DISHONESTY IS THAT I WAS VIDEO TAPED ACCEPTING MONEY FROM SOMEONE ON BEHALF OF THE FIRE DEPARTMENT . WELL LETS SEE AFTER PUTTING IT ON A POSTAL SCALE A DOLLAR BILL OF ANY DENOMINATION WEIGHS 1 GRAM , I HAVE A VERY HEAVY ROUTE , I WOULD LOVE TO KNOW HOW THE 2 COMPARE.....YES ACCORDING TO 1 OF MY LAWYERS EVEN VOLUNTEER WORK IS CONSIDERED WORKING IN THE EYES OF THE LAW !!!
 
Yes he returned all my calls. And when I did not have a phone, I corresponded through emails with him. If he was not in the office, he would always return my emails through his phone. No matter where he was at on business. And respond to me within a couple hours.

I work in the Pinellas, Florida hub. I have seen Brian Rothman taking care of business for us many times. In close to 15 yrs of service I can not count on one hand how many union brothers or sisters have lost their jobs. And if they lost their jobs, they got their job back.

Did you leave your call back information? Send an email? Did you do your part to help settle any problems you might have had? Or just make one phone call expecting the Union to bail you out. It is us, the union employees, working with the union that gets things accomplished. I bet your the type that has never voted, went to a union function, or even looked through the union manual. I can see in your short post you do not take much time to think. It is easy to make an empty comment, behind a computer screen.

Amen Soundwave, there are some good Union agents out there and I am in Florida on the east coast and have heard nothing but good things about this guy. I heard a story form a air driver, preloader who was over here for air driver school who said this guy called him at midnight one night and scared the hell out of him when the phone rang. He was returning a call from the grievance panel when he was in Texas and there was a time difference. It was a return call from that day. I dont know about your agents but mine aint calling me at midnight!!!!

We do know there are some crap agents out there but from what I hear this is one of them who does his job and fights like hell for us. Amen for him.

Tsk tsk tsk. Temper Temper my friend. As a matter of fact I have never once needed the services of the union yet continue to be a member in good standing. I voted on the last contract, and have attended meetings and traing for "The Mighty Teamster Army" (ha I still laugh when I say that).

I am not a blue bible thumper nor am I a company man.

You my friend need to crawl out of Rothman's behind take a look around and realize all that I said is that he is always busy and can be hard to get a hold of sometimes!
 
First off, that is not what you were implying. Second, I am not up anyone's ass. I am just thanking someone that helped me out in a difficult situation. Seems you are a little bit jaded over something.

You are right. You got me. Brian stole my halloween candy when I was 6.
