What we do or don't do out there helps us avoid accidents. Leaving the car length, watching parked cars, clearing intersections, using horn/lights/signals, checking mirrors, staying off cell phones, not using the DIAD while driving, etc., will greatly reduce our chances of getting in to an accident. I had a situation last week where I was following an elderly lady as she was starting to drive through an intersection when she suddenly stopped when the light turned yellow. If I had not had the cushion and eye lead time established and had not followed the stale green light method I would have surely rear ended her. I agree that there are times when an accident is deemed avoidable by the company which the police has deemed not the drivers fault. Getting hit while legally parked and then being charged with an accident is absurd. However, getting hit while parked in a residential driveway is inexecusable IMO.
