from local 493 termination issue

I don't see how using the c word would be insubordination, especially since it is said to have been directed towards a fellow hourly employee.

Regardless of if you said it or not discipline should have been a documentation about using unprofessional language.

Yeah ill deff fight that fact, it deff doesnt make since to me eather..

Insubordination is the refusal to follow a direct order from a Sup that is not illegal, immoral or unsafe. If anyone should be fired for "Insubordination" It should be the dumb c*nt that didn't stop the scan when she was told to...

Even if the steward wasn't sure what to do, they should have at least provided you a grievance form to handle this. I'd be sure to complain to the local about this if you haven't already.

I don't expect stewards to know everything, but if any discipline is handed out, even termination, a grievance form should be issued automatically.

Your supervisor is a waterhead. Was it your supervisor or your sort manager that fired you? PT/FT sups don't have the authority to fire someone in the hub - usually only the sort/division manager can pull the trigger on that sort of thing. It might have been an "off the books" termination where they want you to go home and tremble for a few days before you get a call to come back to work, find out if a termination letter was mailed by the company.

Calling a female co-worker a c*nt isn't insubordination, it's violating the UPS anti-harassment policy and Art. 37, Sec. 1 of the CBA (treating employer/employees with respect).

Also.. one other thing: how far away was she when you allegedly said what you said? For future reference: Let her have her hissy fits and just keep your distance. Hopefully your co-worker is a solid guy and backs you up.

Not necessarily. In a larger local, the BA will typically reply to a termination letter with a form-letter grievance that is sent to the company via certified mail along with a letter to the grievant with contact info. Typically, if an employee is terminated, they don't let them stick around long enough to fill out a grievance and they're marched out. This is probably an internal security policy thing.

Well he is my supervisor.. he runs the whole shift.. not the whole building like the manager sean.. and its been 4 days off so far still wating to hear from my union rep.

Well thats exactly what happen.. my boss said "Im goin to escort you off the premises." i didnt have any time to explain myself in the situation and the steward i had on the shift at that time had no idea what to do ether.
 
so apparently now, i was informed bye the union rep. that hes planing on having a meeting with sean (the building manager) next week and assuming ill be there as some point as well. I was informed that for the best possible was for me to get back to work would be to say something along the lines of.. " I didnt mean for her to hear anything i was saying, I was merely talking to the person next to me. It very frustrating when a person doesn't stop the belt when told to do so."

You really need an answer. Would you ask that question if this was your wife, sister or mother in the workplace. This clown called any one of those that name in front of me, the UPS job would be the least of his worries.

I've had 2 guys in the last 5 years walked out in hand cuffs, but that didn't stop me from having them fill out a grievance form before they left.
The steward has the right and the duty to file the grievance at the time the company takes discipline, as well as the member has the right to file and be represented.
Remember, we are supposed to be innocent until proven guilty.
If the company tried to stop me from completing a grievance under these circumstances, they would likely be walking me out as well.
