Is there any info on drivers with dui's?

We had a guy at our ctr that lost his license for a dui about 7 years ago and they got a guy in to drive for him, he left after a few weeks tho. No way on earth that would happen now

Section 3. Loss of License
Section 3.1 Leave of Absence When an employee, in any job classification requiring driving, loses his or her operating privilege or whose license has been suspended or revoked for reasons other than those for which the employee can be discharged by the Employer, leave shall be granted for such time as the employee�s operating privilege or license had been suspended or revoked but not for a period longer than one (1) year, provided the driver whose operating privilege or license has been suspended or revoked notifies the employee�s immediate supervisor before the employee�s next report to work of such suspension or revocation. The above provision need apply only to the first (lst) suspension or revocation except for suspension of commercial drivers license (CDL) of one (1) year or less duration....


Yes it is in the contract.

1st DUI---you have a year to do rehab and get your $%^& together.

2nd DUI---see above---"the above provision need apply only to the first suspension or revocation".....in other words, after your 2nd DUI the company is under no obligation to retain you as an employee. You dont have a lisence. You cant drive. They can, and will, terminate your employment.

We have had 4 guys get DUI's on my center over the last 10 years. Their licenses were suspended for lengths of time varying from the minimum 90 days for a guy who was barely over the limit up to about 9 months for a guy who blew a really high BAC (blood alcohol content) and also pissed a dirty UA for weed.

All four were seen by the SAP (substance abuse professional) and completed the prescribed rehab. (Art 16, NMUPS). All four worked in preload until their licenses were cleared.

Two of them got a second DUI. Those two were terminated, and their terminations were upheld.

Dont drink and drive.
