Were we not conversing about the dishonesty of management? I commented about you running the ship......you brought up profits....not me. Those profits are great,when they come at the cost of harassing injured employees? Hmmm says a LOT about you if so. Ohh....that's right, that kind of treatment does not happen in your center.....therefore it doesn't exist....I get it....carry on....sheesh wake up

Yeah man the company never subverts the contract and then is told they are wrong at grievance hearings only to try to intimidate the writer of the grievance into not taking penalty/back pay.

True, everyone does make mistakes. That's why I came to this forum: for advice and opinions regarding my current situation. I want to consider what wise non-"newbies" like yourself have to say before I take any action. That way maybe I can avoid making a mistake.

I sustained an on the job injury and was on workman's comp for 2 1/2 months. I maintained contact with my center for the duration of the time I was out. The week before I returned to work, I received a happy little certified letter from my center accusing me of being AWOL for a month and informing me that I had 3 days to report to work or I would lose my seniority.

Naturally, I was livid and confronted my center manager about it. He said that the date stated in the letter as the date I was supposed to be back at work came from my last Doctor's note. The problem is that wasn't true. I had the note with me to prove it, so I handed it to him and asked again why he had sent me a letter accusing me of being AWOL since a specific date that was not on the doctor's note. He said he guessed it must be a mistake and tried to blow it off. I wasn't satisfied with that explanation so I asked him how a mistake like that could be made. I asked him specifically where the date that he "mistakenly" thought I was supposed to be back at work came from since it obviously did NOT come from the doctor's note, and a specific date had to come from somewhere. There was an awkward silence followed by some mumbling and then the "reassurance" that I didn't have to worry about that letter...

Something shady seems to be going on here. Were they trying to get rid of me? Were they trying to cook the books in some way? There is no way this was an honest mistake...

Thoughts?
Get a lawyer, and google Lawyers who have won lawsuits against UPS, good luck.

Your "claim" is.... you have 3 herniated discs from an "on the job" injury.

And are back to work, in 2 1/2 months.

That's a miraculous recovery.


But....

You haven't (claimed) to have filed any grievances (or the disposition)

On what you say, are OSHA safety violations.

I do have 3 herniated discs. I am back to work in a limited capacity. I am not fully recovered. I am still being treated by an orthopedic specialist. I get to start a series of epidural steroid injections this week. That should be a blast, right? Hopefully it works, i'm not real excited about the surgical options. So no miraculous recovery just yet. But thanks for noticing I'm a bad-ass!

I have not filed any grievances yet. Again, I came to this forum and started this thread for the purpose of seeking the advice and opinions of my UPS "elders". I think it's important to gather information before jumping to conclusions and messing with another man's career.

And I don't say they are OSHA violations. I know they are OSHA violations. I gathered that information already!

Keep plugging away at gathering as much information as possible but get a lawyer for real dude cause you may need 1. Especially if you hurt your back, that's a serious injury dude for real and could be a problem down the road. Nothing to play around with at all. Hopefully you may not need surgery but if you do need surgery, do your homework and find a top notch surgeon through homework on the internet. If I ever hurt my back ill probably go to the Rothman Institute up in Philadelphia. Top rated and they do all the Flyers, Eagles, Phillies surgeries a lot. Don't back down from these jerks because if you hurt it at work they need to pay you for it in any means possible. But you better have a dam good lawyer dude for real because that's what its going to take to win against these asczzclowns lol.
