Well, I would like to thank Local 396 for their outstanding work in presenting and wining the recent arbitration held before Fredric R. Horowitz.

Mr. Horowitz authenticated Arbitrator Howard S. Block's decision handed down in January, 2005.

Most importantly, Mr. Horowitz retained jurisdiction to ensure there would be no company retaliation or other "funny business" in setting a new daily production standard based upon a three (3) day ride analysis.

Yes UPS can hold drivers to a daily production standard based upon a 3 day ride but that standard must be fair and just and must account for the many variables that can affect a driver's SPHOR. ("A fair day's work for a fair day's pay")

The standard must be "REASONABLY" maintained in accordance with the same latitude allowed all other District Package Drivers. (No more singling out employees)

This decision is now part of our CBA and thanks to 396 for ensuring the company can't harass, intimidate or otherwise try and run us into the ground.
