Part Timers Overtime Question

My helper sometimes works over 8 hours on the preload, 3 of those hours are overtime. He then works 4-5 with me as a helper. Since he is already over 8 hours for the day shouldnt all of his helper hours be overtime? Steward says yes, Business Agent says no, and of course UPS says yes and no depending on who you ask. I know its a different job and pay scale but it doesnt seem right to me.

Depends on what your local supplement says. You are going to need to read your contract. It would also be worthwhile to know what your state's law is regarding OT. In my state, anything over 45 hours a week with the same employer is OT. There is nothing in my state's law regarding amount of hours in a day, only in a work week. State law supersedes the contract.

There's a weird contract stipulation in some areas where if you work over 8 hours on one shift, then you're ot changes to over 8. Don't know how they get away with that...but unfortunately they do.
