I agree. No new ground in 20 years...so how are we still in the same position?
I think it is the vaguenessof law. The list that the IRS uses is not specific to Ground so to change it meaningfully could have massive economic consequences. Maybe we need those consequences though.

Lawyers. FE will continue to appeal until every appeal is denied. That takes time. It could be 20 years before this is resolved.
There was a class-action in Ohio that had been decided against FE 12ish years ago. Pretty sure that is still tied up in appeals.
