UPS Work comp. Support Group and Bitch Thread. . .

Our local insists that when we are injured we go to our own doctor or the ER right after we notify UPS that we are injured. I haven't had any injuries that serious yet so I can't speak to whether or not that actually helps or not. I just think its funny when I see Liberty Mutual's commercials claiming that responsibility matters. Liars!

HELP!!! Our FT sup's insist we wait until an urgent care opens at 8am in the morning. To me that means they are making a "medical diagnosis" that the injured worker does not require emergency care - such as for a wall falling and getting hit in the skull.

Please explain how you go to the ER without a Liberty Mutual claim number? We're basically kept prisoner until we either decide to wait until 8am or "feel better".
 
2008 - i remember getting dressed for work then nothing for 3 days. i fell 9ft onto a concrete floor. care-flight to local trauma center, 3 days in icu, 3 more days in a regular room. went to follow-up appt per ups instruction at a doc-in-the-box and he said i was fine to return to work with a broken cheekbone, torn rotator cuff, and a broken wrist that eventually required 3 surgeries over the 6.5 months i was off. and also in my case liberty mutual was less than useful.

I am presently off on disability after having surgery for an right side Inguinal hernia, 8 week recovery.
There has not been any glitch in my healthcare that a 5 minute phone to Central States call has not corrected.
This ain't my first rodeo with Central States, and UPS.
In 1994 I had a left side hernia surgery, 12 week recovery, during peak, and not a glitch with doctor's, or insurance coverage.
In 2010 I had half my colon removed due to cancer, 8 week recovery and only had to pay 38$ to a pathologist.
Never in my 27 years employed at UPS have I ever been denied the promised coverage.
Any time you have to lawyer up, be prepared for a fight.

1994 hernia was covered by Workman comp.
My 2013 hernia was diagnosed in 2012 by the company doctor during my DOT physical. I could have got into a dogfight claiming work comp, but I did not due to the fact I could not pinpoint the exact time of injury and blame UPS.
This old dog knows when to fight and when to eat on the porch.

I can't remember the last time I was checked for a hernia during a DOT physical.

Do what a coworker here did, call 911 ! If you are hurt, they must take you for treatment. I would look at the sup and say ( with a shop steward present) are you going to call 911 or do I have to ? They really dont want that because it will be reported to OSHA... I would put the ball in their court, either take me to the ER, or I will call 911....Also as far as diagnosing the injury, they can get in trouble for that too, it is "practicing medicine without a license".. Throw that at them too.

It's been a while since I was hurt on the job (different job), but I had a choice between 3 doctors, I think that is the law. So it wouldn't really be the company's doctor, it would be your doctor. So you would be looking at a malpractice lawsuit, which a dozen different dirtbag lawyers would jump at I'm sure. Just don't complain about health care costs afterwards because you would be contributing to that madness.
different states different rules. I've had four work comp cases. you can go to your dr. but you also had to see the company dr. and if they decided it wasn't on the job or there is no injury your work comp stops there. My point on the medical malpractice is simply this, the company drs. are like management in that they lie until someone calls them on it. It needs to stop

Even following the safe work methods, accidents do happen.. I would rather be at work, than having to face another surgery, paying 1200.00 per month for cobra, and loosing money every week I am out of work.. What would help is Liberty Mutual sending injured workers to a specialist much sooner than 3 months after the injury..

WHAT BS. . .I was following methods and still hurt myself. All of a sudden after my incident they started talking about putting yourself in 'double jeopardy" doing two safe methods at the same time. . .WTF shouldn't that be twice as safe? Everyday drivers (employees) are hurt, but UPS's response is always gonna be the same, you shouldn't have done it that way! If you're standing in the building and a ceiling tile falls and hits you in the head. "Well why weren't you in the designated break area?"

I got hurt on the job Jan 2012 running my route. I got released Mmi in June and now ups has me on a leave of absence. I have a permanent restriction of lifting no more than 30 lbs. I should either be fired or back to work, I had no idea there was a gray area. How can they just put you on a leave of absence. I haven't gotten paid since June and this is getting old. Any help would be greatly appreciated. Thank you.

Took 2 months to finally get denied an MRI. Went to my doctor and within 2 days I was getting my MRI. I thought TAW was supposed to last 30 days...

Get online or drive to your local Social security office.. Take all the information you have about the injury.... The doctor's name address phone , ( all doctors) also have the date of the injury, and any documented diagnosis, basically take everything you have about the injury. I found out if you are out of work on comp you are eligible for getting disability . It takes four month for the application process, and it is usually denied.. After it is denied, get an Attorney to get it resolved. Also, file for unemployment, that too is allowed even though you have a job, you are not working.. GL

I was wondering if anybody here got retrained to do something else after WC and could not drive anymore for the company.

In most states your employer can place you in a different job, part time or full time if you are able to do the job.. In some states you have three years to get back to 100% and do your previous job. If you are unable to do the job that you held when you were injured, the company has the right to let you go..The laws for workers comp have changed so much in the past few years and they favor the employer not the employee. So basically, if you are a driver and are injured and are unable to do that job, the company can offer you a part time job. After three years if you are not able to go back to the driving job, you can be released. Best advice for any injured worker, get an attorney.

Hear the same thing from management. However, I tell them even with periodic vehicle maintenance we still have batteries that go dead, brakes need replaced, tires go bald, lights short out. In other words parts and people do wear out.

Here in our center a driver just cameback after a long time on WC [permanent and stationary] with restriction, but UPS send him back home because they have nothing for him. WC is not paying him benefits anymore so he's screw.
