Actually, this accident is management's fault. They failed to train this driver in the 10 keys to avoid getting rear ended even though you're moving.

The driver can grieve the discipline. He can not grieve if it is chargeable or not. UPS may change it to a verbal warning or change it to unavoidable to avoid the hearing.
