Question Can laid off freight road drivers bump back into P&D

At my teminal ORO/400 we have been loseing road runs like crazy starting 10/12/09 were losing 3 more not because we have no freight but because of all the contractors we have coming in loaded and lately theyve been pulling loaded sets out when we have drivers working the dock or sitting at home waiting for the phone to ring. There also cutting 3 city routes. Meaning that a total of 6 more drivers are coming to the dock Is it right that the road drivers can bump back into the city even though they are changing classification from road to Local cartage

Because you asked.

ARTICLE 5
Section 1. Seniority

(d) For full-time employees there shall be two seniority lists, “local
cartage” and “over-the-road.” There shall also be a separate “casual
local cartage” seniority list. Employees in the following classifications
shall be included on the local cartage seniority list: all truck
drivers, helpers, dock workers, jockeys, and such other employees
as may be presently or hereafter represented by the Union, engaged
in local pickup, delivery, and assembling of freight. The “over-the road”
seniority list shall include all over-the-road drivers whose primary
job is to transport freight between the Employer’s facilities.

(e) The Company shall offer extra city or dock work to road
employees who are on layoff and who are qualified and immediately
available for city or dock work prior to using casual employees,
except where there is a mutually agreed procedure to the contrary.
No road employee shall gain “local cartage” seniority under this
provision, but he/she shall accrue Company seniority.

The answer is no... If you are a laid off road driver then you must stay in your job classification. You can ask to go P&D but... you will start at the bottom of the seniority list for that job classification. Your "Company" seniority only applies to "Company" layoff.

That does not make any sense, if a road driver's run gets eleminated then brought into the city route & given other city driver's hours becuase of seniority, does that mean the bottom seniority city drivers get laid off? Arent these road drivers suppose to be starting at the bottom behind all of the city drivers?

Yes... at the very bottom that he/she changed into.. Displacing the bottom driver he/she changed into. Meaning... That driver will more than likely walk. So on and so on... Until he reaches the bottom of his seniority date of the job classification he change into.
