But in the instance that UPS does go under financially, the funds in the APWA pension plan would not be affected because this is not a company managed pension. Once those monies leave UPS's bank account and enter the APWA pension, UPS has no control of them and would not be able to use that money to save their hide, and bankruptcy court could not seize them either.
