I work in Maspeth and was part of that day. We were all fed up with UPS management violating our contract rights! What they did to the driver that was fired was made up lies by the manager. We were all upset and willing to stay outside. Even when told to go in, we stayed out for almost 2 hours in the snow. The next week on Thursday in the office, UPS read the contract to us. I went home and checked it out because I couldn't believe I was fired but working. Something is weird about that. I know UPS like to keep us in fear but why keep us working? I found what they read to us. This 1st part is interesting: Section 4 – No Strikes or Lockouts (a) The Union agrees that it will not cause or permit its members to cause strikes of any kind, stoppages,or any other interference with any of the operations of the Company during the term of the Agreement,so long as the Company abides by the procedure prescribed for the settlement of disputes and differences and the decisions of the arbitrators as provided in this Agreement. The Company agrees that there shall be no lockout during the term of this Agreement,so long as the Union abides by the procedure prescribed for the settlement of disputes and differences and the decisions of the arbitrator as provided in this Agreement. What is the procedure prescribed for the settlement of disputes and differences? If UPS didn't follow procedure doesn't that mean we can Strike? Doesn't that mean it is legal? If it is legal, than wouldn't the next section on illegal strikes (18.5) not even matter? Can anyone answer this?
