Seasonal Driver On Call All Day?

Usually they call me in the morning when I am working, today they basically want me to stay on call all day? Are they even allowed to do this without paying me?

Your obligation is up to your building's start time only unless otherwise instructed. You are not required to be "on call" beyond that point unless they are willing to pay you to be "on call", which they won't.

The driver is seasonal hence he is trying to get a permanent job. Not picking up the phone will not help in that regard; however, he should not be sitting by the phone all day, either. If they don't call him by start time or schedule him the day before he should be free to go to his other job(s).
