Surgery denied

My job is fun
So friend’r up my elbow at work. Went through the process for their doc etc etc. doc said we need to do surgery and today get a call and it says denied bc a doctor somewhere else it’s not medically necessary. Need some insight what to expect from here on out. Obviously getting lawyered up. But it’s frustrating that someone hundreds of miles away has a say when they have not even seen me.

They must of sent your xray into a specialist

Sorry, but I don’t care anymore.
My doctor is a ortho ups sent me to and he saying surgery. Liberty mutual doctor that is in another city reviewed it and said no.
Of course he did! Can you go to your own orthopedic surgeon? I believe you can. Unless they changed it. I had shoulder surgery and UPS had to pay who I wanted. All WComp.

In my state I don’t believe so. They gave me an option of 3 orthopedics to choose from
You got one more. Talk to a comp lawyer, union may be helpful there. If they still won’t let you get the surgery they may be right, but I would still demand physical therapy at the least. Your gonna have to take time off for that but if it’s comp you’ll get a check. If you go back to work and it still bothers you, come in one night and tell whoever is covering that your elbow is killing you and your going to an ER. The Doc there will X-ray it again prescribe rest and meds, more time off. This will get old real quick to them and if you genuinely need the surgery they’ll be more than willing to let you have it. It’s a game, but if you work with a screwed up elbow it could get much worse for you.

In California we are allowed to predesignate our personal physician for workplace injuries. If no predesignation is on file, we must be treated by company doc for at least 30 days, then we can see our own doctor. Insurance company will deny everything. Get a lawyer asap. Even for the smallest injury.

Workers are afraid of getting a lawyer because they think that the company will be upset with them. Company doesn't care, you are dealing with an outside insurance. Also, an injury you think is minor may lead to a major problem when you get older. What happens when you can't carry your grandkids?? Always be on the safe side. Report everything and hire an attorney

That’s what my next question was going to be is if I get released and it hurts do I go back out again or would they say since they denied it it can’t be a workmans comp injury anymore

No your on record as soon as you went to their Dr. If it happened on the job it’s comp. Even if you had a problem years ago with that elbow, and you had no problem all this time, the job made it come back, comp. GET A LAWYER! Do not trust liberty mutual! UPS is self insured, Liberty manages the money so they’re like the gate keeper to the funds. They initially tried to deny my shoulder because I had dislocated it 17 years earlier before UPS. Law is they hire you as you are, anything the job makes worse is on them. It cost them plenty, I was out almost a year!
