So, I got an email back that said my last day will be Oct 31st.
I kinda wanted that day off to take the kids trick or treatin.
Can I negotiate the date, or maybe use an optional??

They rolled this out too fast.
Didn't give people time to plan.
The way I see it is people should keep doing what they were doing before. And if they end up getting anything extra from UPS look at it as found money. If I was that close to retiring anyway I wouldn't let UPS dictate how and when I could go. No way I would jump into this mess with the short time you are being given.

Are they going to take 401k money out of that lump sum?

Many people might be surprised at income tax time.

If this goes through, it must not be a violation of the contract, correct?

Can't help but see this as a precedence moving forward. Future job cutting, building closures, pensions, benefits, etc, all open to reinterpretation.

A dangerous slippery slope.
Nobody is making anyone take this buyout. If you don’t like the terms ignore it. If you’re on the way out pickup the check on the way out the door and don’t look back

If you view this as an egregious violation of the contract, their breach might justify a legal strike.

Nobody wants that but this is a dangerous path to head down.

We're going to strike because UPS wants to buy out some old-ass-should-be-retired employees?

The strike would be because UPS has egregiously violated the contract, specifically Article 6.

I'm not so sure this is a violation of Article 6.

Article 6

Except as may be otherwise provided in this Agreement, the Employer agrees not to enter into, or attempt to enter into, any agreement or contract with its employees, either individually or collectively, or to require or attempt to require employees to sign any document, either individually or collectively, which in any way conflicts with the provisions of this Agreement. Any such Agreement or document shall be null and void.

How would taking a lump sum payment to resign from the company violate a provision in this agreement. There is no contractual language involving resignation, or separation, or lump sum payments.

I believe @BadIdeaGuy stated that there is a clause in the 710 contract about resignations, so there may be an issue there, but not in the NMUPSA.

And I think O'Brien knows it. He asked us not to accept the offer and to file a grievance.

What’s to say this isn’t the only buyout offer the company offers. What if you take the $1800 offer then the company is like enough didn’t take it let’s offer a little more money and see if anyone takes it. So you get screwed by taking the 1st offer and the Union doesn’t have to help because you chose to leave.
How are you getting screwed accepting free $$$
