We're going to strike because UPS wants to buy out some old-ass-should-be-retired employees?

The strike would be because UPS has egregiously violated the contract, specifically Article 6.

I'm not so sure this is a violation of Article 6.

Article 6

Except as may be otherwise provided in this Agreement, the Employer agrees not to enter into, or attempt to enter into, any agreement or contract with its employees, either individually or collectively, or to require or attempt to require employees to sign any document, either individually or collectively, which in any way conflicts with the provisions of this Agreement. Any such Agreement or document shall be null and void.


How would taking a lump sum payment to resign from the company violate a provision in this agreement. There is no contractual language involving resignation, or separation, or lump sum payments.

I believe @BadIdeaGuy stated that there is a clause in the 710 contract about resignations, so there may be an issue there, but not in the NMUPSA.

And I think O'Brien knows it. He asked us not to accept the offer and to file a grievance.
The fact that it's the first time ever this has been attempted makes me wonder that it may be a violation of Article 6. It's individuals entering into an agreement that's terms have not been negotiated with the IBT. I think the legal question would be if it in any way conflicts any provision in the agreement. Of course it may be moot if the IBT simply sits back and takes no action other than just let the grievance procedure run it's course. If they don't attempt to get some sort of temporary injunction relief then the rest doesn't matter.

For each center? Or the entire country? It does say based on company needs too correct? What if a smaller center has several high senior drivers that can't afford to be let go and a huge center can absorb the loss of lesser senior drivers than that small center? Just wondering how in depth the company has planned that part
