Seniority has the prime consideration or not?

My union agent has taken over 2 months to do something about my seniority violation grievance and he always gives me the run around “I’m trying to set up a meeting”. I’ve called him like once or twice a week for the past 10 weeks and hasn’t done anything about it. My issue is that someone who was pregnant got to do an easy job at the hub I’m at during her pregnancy. This was a job done by management until they put her there. Now she’s not pregnant and they don’t want to go off seniority. I have a whole extra year ahead of her on seniority. Now management is saying that’s not why she got the job and they want to keep her there. No bid was put up for the spot so it’s all bull:censored2: when I’ve been working here longer busting my ass. And union isn’t helping so what now? I have filed 2 grievances already. How many grievances can I file in one month?

What's the Job? What supplemental contract are you under?

I’m in the western region of the US. And the job is an escort that brings in trailers to the hub. So basically you sit around all day in a truck with the ac on and all you do is guide the trailers to where they go or out the hub.
Other than the western what rider or JC are you under?

No. I worked my way up from a package handler to the ramp. I’m certified on everything except forklift. Yet I can’t get a measly job that I’m sure I earned compared to someone with lower seniority.

When you filed the grievance did you add "and all applicable" to Art 4.3?

I feel like you may get screwed on this. The company will say your grievance is untimely.
Yeah it does say that under 4.3. What management is trying to tell me is that she’s been in that position for longer than 6 months so I can’t take her off the position. The only thing is that she got the job because she was pregnant. So I talk to my manager and he says that’s not why she got the position. When I go around asking everyone and they say it’s because she was pregnant. So he’s already lying and one thing I left out was that a shop steward was holding the position once she went on maternity leave for three months. I tried to get the position from him as well since he has lower seniority than me. But he is known for helping management and management allowing him to blow off work and walk around on “official union business”. So him being the senior shop steward he advised me that my grievance would not go through and that he would not file it for me. What a ducking coincidence ain’t it? Long story short they put up a bid for the job after threatening to right a grievance but only as a “backup” in their terms but I have told my union agent that no list was ever done before that, many others as well, I’m not the only person mad at this situation. I of course won that bid and I am trained and everything. Now the only thing left is my union agent to force the rules on my manager to put me in the position fully.

Besides all the duckery going around. Shouldn’t shop stewards be held accountable for false claims? These clowns follow orders from management all on their own benefit while all the workers have no where else to go so they put up with it. I know it’s all up to a vote but shouldn’t there be some repercussions that don’t need a vote to kick them out? Especially when everyone complains about the shop stewards.

I don't know your bylaws but you could always try and become a steward.
