Packing with just more justices is not my ideal solution. Any of the reforms that bring some balance/legitimacy are better. There’s plenty to choose from. If there was such a thing as a reasonable Republican I think there could be bipartisan support for some reform measures. When Democrats controlled Congress and the Supreme Court was liberal for decades there was never an issue. Now you think the system needs reform. You guys got complacent, didn't understand what your constituents were trying to tell you. Here's a novel idea, EARN the voters' trust. Thought I read the other day that Ted Cruz was putting something together, a Constitutional Amendment, concreting in no more than 9 justices in the Supreme Court. I think that's a good move. The current president earned fewer votes than his opponent and the Senate majority members earned fewer votes than the minority. I don’t believe a Republican controlled Senate will ever seat a Democratic president’s nominee now under the current rules. The number of Justices will vary until the rules change. Either there will be fewer justices with divided government or a packed court with a unified government. That makes the court an unelected partisan super legislature.
