United Parcel Service must pay its California employees up to two premium payments per workday if it fails to provide meal periods and rest periods, a state appeals court has ruled.
A premium payment is a paid hour at an employee’s regular rate of pay.
The 2nd District Court of Appeal rejected UPS’ bid for a ruling that only one additional hour of pay for each workday the meal or rest period is not provided, regardless of the number missed.
