My business management professor told us that its unlawful to give a former employee a negative reference.

Even if it is justified?

It isn't illegal to give a negative reference, just not advisable. It's not worth a possible slander lawsuit (bogus or otherwise). Most companies HR will only verify employment, and (rarely) a positive reference if applicable. I've never heard or heard of anyone getting scorched on the record during one of those phone calls.
