UPS Hit With Suit Over Trademark Threats Against Worker - Law 360

A United Parcel Service employee sued the company in Georgia federal court on Monday after being threatened with a trademark lawsuit for using the company’s name, logo and colors in the course of criticizing the treatment of workers.

Carl Gregory, a driver and warehouse worker in Florida, filed a declaratory judgment lawsuit to prove that the First Amendment allows him to use the company’s trademarks to criticize a recent collective bargaining agreement struck between UPS and the Teamsters union.

The use at issue? A business card.
