How could the OP have been sent home if he was told not to come in to work?

Since the OP did not request his guarantee, he is out of luck in asking for pay for the days that he missed.

Show up Monday morning at start time ready to work.

I hate to go over this, but you don't have to request your 3 1/2 hours to get it. Once they send you home against your will, then that's it, you are guaranteed 3 1/2 hours. The op can say that he was working as directed and following procedure. Your arguement has been debunked.

Do you have a start time, or are you on call? If you have a start time, then go into work, you get the guarantee(if you qualified), if no start time(on call), then you are out of luck.

Having that issue right now with a close relative. Pre seniority 15 working days. Posted start time and area. Told to go home after an hour two days and told to go home another day. No work problems but the weather has been very cool last couple weeks so guys that normally take off when it gets hot are staying. Told him to just be cool and when you get your 30 days in then you can start demanding your guarantees.

If he was told to stay home, and there are less senior guys working, then he is guaranteed 3 1/2 hours of pay.
Pre seniority. No one lower. And how would he know that? You guys have no idea what it is like to be pre seniority or even having made your 30 days. No wonder the young guys don't want to join the Union.
