Use of tear gas in warfare, as with all other chemical weapons, is prohibited by various international treaties that most states have signed. Police and civilian self-defense use is not banned in the same manner. Armed forces can legally use tear gas for drills (practicing with gas masks) and for riot control.

Police can use it, it’s an alternative to more deadly force. When used in warfare it can be more deadly. It can also be use first distract the enemy then allow you to come in an mow down the enemy.

Military can use white phosphorus which is a lot worse.

think of the logic, why would htey ban it in war and not in riots?
