Actually @newfie was partially correct, jurisdiction is a given in this case, however a successful prosecution is determined by evidence. He was 100% correct in the saying prosecutors do not absolve. A prosecutor chooses to move forward or not pursue charges or indictment in a case. This instance is different from a regular criminal procedure. This prosecutor was not presented with charges, he was presented with an open field to find something to charge, based on a notion.
The major problem that exists lies in where exactly did this notion come from and was this notion supported by truthtful information to the court (actually judges) that gave life to it. Complicated but not.
