What I can't seem to get is while they drag their feet giving authorization for procedures they are still paying comp pay. You would think the faster they give approval,the faster you get back to work and no longer need comp pay. Like stepping over a dollar to pick up a nickel.
Hurt my neck on the job. UPS doctor wanted me to see a specialist. Neurosurgeon wanted an MRI to asses the damage before he did anything. It took UPS 9 months to approve the MRI. Sat at home collecting comp the entire 9 months.

If work hardening doesn't get you to where you can do all aspects of the job, including the long hours, then they will try to put you in vocational rehab. That is basically training you to do another job, but not with UPS!

Or, negotiate a lump sum amount and break your seniority.

No It's not green grocer!
We had a guy get hip replaced. Had 50 lb weight restrictions. Reached mmi still with the same restrictions. He is no longer with ups. He did not report his as work comp though. I'm sure it's different when it's on the job injury

If you filled out Ada paperwork your screwed. That gives the company pretty much all the time they need and all they have to do to satisfy the courts is say " we are looking for him a position". They will put your settlement or buyout off for years if they choose. Trust me I know. If they send you or you have filled out paperwork talk to your lawyer. All you have to do is Google it and you will see for yourself.

$8/hr is really $5.50/hr..how many times have people corrected your misinformation?

I honestly believe you do this subsconsciously to delude yourself into a payrate that is relatively higher than it is, versus others. Do you see a problem with this?

when I tore my rotator cuff pulling a 5th wheel, (MRI showed total tear) UPS did not approve surgery. Instead I went to like 2.5 months of therapy 3 times a week, 2 hours a day. They did put me on TAW, so I got my 10 hours a day, even though it was just watching tv in the break room all night. LM (after starting and stopping my therapy 4 or 5 times and the doctor had to request more in writing) Told me I should be cured by now. I said, no there is still something wrong. Turned out I had nerve damage as well as calcium deposits and a bone spur. Drivers would tell me how I had it made I told them to try and sit on a hard bench for 10 hours. Believe me, I'd rather be going down the road in an air seat listening to XM. Had the surgery, therapy all over again for 5 months. They sent me to hardening therapy, which consisted of walking 2 miles in the morning with people who had bad backs, legs, etc. laying on mats and doing exercises for 2 hours, go to lunch, walk 2 miles again, then play bean bag toss for 3 hours. (it qualified as therapy) My bean bag game got a lot better, my shoulder not so much. I actually complained to the drs that I wasn't getting enough shoulder specific work. The last week I was there. I did all shoulder therapy. They pronounced me fit to go back to work. I couldn't climb up and down off a tractor 30+ times a night (in my opinion) safely. Luckily, I had enough time in that I just retired. Also, with the TAW, I got exactly enough punches (156) to qualify for my 6 weeks vacation. LM never ceased to amaze me at their logic.

As for my surgery, I initially went to the doctor as a non-work related injury but it was determined that my repetitive motion injury was indeed work related. Comp not only paid all my future bills and paid me but they also paid for all of the bills I had incurred up to that point.

We were told by our BA that she took an $8/hr paycut when she accepted the 22.3 position. The wage is not the point, which is that the company and union worked together to take care of a senior employee while making sure she was no longer a danger to the public on the road.

It seems to me as though the union and company both take the position of opposing ADA claims. These are the same corporations which bombard the public with PR supporting and even championing those with disabilities. ;p

I was a local driver. I ran 2 CPU's that I had to pull and replace on the same door, plus I shifted for about an hour at one of our extended buildings. I also built and broke 2 sets during the night.

It seems to me as though the union and company both take the position of opposing ADA claims.

The company takes the position of opposing a ADA claim, if it doesn't fit within the guidelines.

If the Union doesn't agree with their decision.... thats what the grievance procedure is for.


The National Panel has a separate (sub panel) just to hear these types of cases.
