Thanks, yeah the game plan is to get back to work. This is the first time I have ever had a work injury and went through comp or even an injury of a serious nature period. It's just the amount of time that goes between the day I went out and still out, that you start to get paranoid about just wanting to make sure you have your job and having to sort out the b.s. and what is reality from all the conversations you have with the 101 check in people while your out. No doubt about wanting to go back, if they said you have your choice of going back to work now still not right to keep your job or staying out getting better and not having a job I would be cutting this shorter and on my way to work. Everyone has been really good to me on all levels of ups and comp side, besides this adult baby sitter that follows me around wanting to hold my hand like I were a child or whatever. I just want to make sure I have medical care in the future if things dont work out right-right now, I heard if you get a lawyer, your saying it was they're fault and you really start a battle. Thats kinda funny because I have the original injury report (the one where it says shred or destroy after you input it on something?, that they take claim for injury).

Waiting is all part of the game. Your job is there for you, when you get back. Get better first, this is your life and you need that hand to be 100%. Getting a lawyer gives you the tools you need for going either way. Just take it easy and get better, you'll be fine.

Don't be too sure of that. Isn't there some language in the new contract about comp? Something about not holding your seniority if your out for an extended period of time? Maybe someone can chime in but I believe there is something about that. Anyone?

I would have thought with the deductions that union take out of our checks that they would want to help the injured to the fullest and want to get them back at work, or something to that effect.
When I had a comp issue with UPS the only advice/help I got from the union was to get an attorney. Besides while your out on comp UPS still has to pay the union for your benefits.

I thought that was disability.

I was out 27 months with back surgery. I returned this summer with no loss of senority. UPS paid the union for my benifits for 18 months. After that they offered COBRA at $900 per month. I did get a laywer and have not had any problems with UPS since my return. While your out keep track of all your travel expenses and watch for the PI's from Liberty Mutual, I was followed several times. Good luck

Ahhh, it's bad enuff the assigned nurse baby sitter person follows me to all my appointments. Thats funny though, one of my buds from work said the same thing about watching out for the PI, I thought he was jokeing though.

Yes the PI is true and I will post pictures later to prove that I have been watched. What is crazy he parked where everyone could see him. I can almost zoom in and see his GPS address. After doing my research I found out who he was, who he worked for, and then went and filed a police report on him.

Once again I would advise people to check out how things work in their state- district or local. As you should know by now - one rule does not cover ALL of UPS. You might not lose any senority but after being off one year you might not gain any more either. ( that's the way it works here) Come time to retire you could be short of vested years. :peaceful:

... To the person who said something about a withdrawl card with the union, do you just call them and mention that, I talked to one of the ladies a couple months ago before I went out and she said they just make it up when you return, but she wasn't my rep so that may be why she said that.

I don't remember much about my Workman's Comp case (it was just a back strain, and only somewhat more severe than the ones I work through), but I did nearly die last year from undiagnosed diabetes and was out a few months after my kidneys failed and I went into a hyperosmolar obtunded state (I think it was called). Anyway, the union required a check for 50 cents to get the withdrawal, and then proceeded to lose it and ask for another check, then they took the 50 cents out of my holiday pay and sent back both checks, and then because I got holiday pay for the Fourth Of July they took out union dues for that month even though I was on withdrawal and on my back at home. It really takes UPS to make the union look good by comparison...

Why not just save gas and jump in with the nurse? Mine drove me to a bunch of places.

:happy2:when i worked at browni had no problem of comp.course the way things change today. i would call a comp lawyerbefore going to the co dr.take there advise.as far as a comp nurse i would talk with dr.when the nurse wasn't around.there is a privacy law.any way the comp lawyer could tell you a lot.this is a different company today.that's why call a lawyer.the c.m. won't harrass you.:peaceful:

I have been to four doctors thats they provided three say I need back surgeory to attempt to do my the other said I would be fine guess which one they went with not the three. I have lost my house my credit rating my car and I am depressed, this has been the worst I have ever gone through. I have never been injured or filed workers comp do everything that you have been advised to do, I pray you don't go through the samething that I am currently expierncing Brother.:angry:

What reason are they trying to use for stopping your comp payments?

Are you doing physical therapy or anything?

About the jumping in with the nurse, I would but then what would I do with the car afterwards :). I can say anyone who has even a 25watt light bulb on in they're head dealing with work comp can tell who is in the comp pocket and who is trying to set the bar for thos who are not in the comp pocket. When I went through my first hand full of comp doctors the nurse would walk around the offices like she owned the place and talking to everyone on a first name basis and the doctors that are in they're pockets look at you and you can see that they know you know they are in they're pockets and you might as well be thinking about what your going to have for dinner that night while he is talking. Almost like the whole staff is infected with comp itiss. Then by luck somone slips and you end up seeing a doc that just gets livid and talks about the doc's in the comp pockets and you end up with a whole new team of spec that repay your last lost by making it very clear they are for the patient, put the assigned nurse in her place and voice that they will fight comp to have to get on the right path. I know this is alot of talking here, but if helps the next guy down the road, this web site has served a purpose. That and I think my pain meds kicked in, so this is where I sign out.
 
I have the doctor that my center manger took me to the day of the injury,and several back surgeons 1 of them says he has people that do their jobs all day long with my problems. I asked him if any work UPS he proceeded by leaving the room and releaseing me to full duty. UPS is a good job, the best I have had I liked my job and my poisition. Considering what is required of the job, injury are bound to happen then add on more work because of pass and less time allowance per stop.


Life was good until my injury now it is a nightmare!:angry:

I have told my boss many times that even knowing the 10 point commentary, 8 keys to lifting, 5 seeing habits the act of contrition, and the gettysburg address... some injuries will still occur because ours is an ATHLETIC OCCUPATION. We all try to be safe, but "stuff happens". Unfortunately, it effects your center's numbers and most mgmt teams will fight to keep it from happening even after the fact. The only advise I have for you is to ask for a second opinion. Tell Liberty that even though you've been released by this doc, you are still having a problem. Ask friends and family or anyone you trust about other docs (preferably a back specialist) and find one that's reputable and on the approved comp list. I can't say this enough... you get to pick your physican. Best of luck. I hope your nightmare ends soon.

Ditto, what he said. I was released by the Dr several times, only to go right back. This happened till I got my situation fixed. I plead with you guys to get a lawyer, as they will know the comp laws and help you through your individual situations.

Me too. I was visited two times by private detectives who "just happened to be in my neighborhood." Yeah, right. My street is impossible to find, so this excuse was BS. As long as you are honest about your injury, no problem.
