I am sincerely humbled! I often feel that I am the only man on a soap box screaming about injustice, there is so much of it. I wish there were more STEWARD'S like you.

Was a steward in the office with you when you wanted to record the meeting? What did he/she have to say? Where you on the clock during this meeting?

The NLRB either in Jersey or Philly if im correct just ruled that the union has the right to record. Im not sure if it spells out conversations, or to video safety problems or contract violations. I record safety problems all the time when im not on UPS's dime. I feelif UPS can use videos and pictures to prove their case so can the Teamsters.

Get with your state law and becoem informed on what you can and cant do. I see people all the time that want to fight the fight but dont know when they have crossed the line and they are to stubborn to admit they are wrong.

If you constantly look for injustice you will find it. Just do your job as instructed. The rest is just self-induced drama.

Well, as of Sept. 2 my employment was officially terminated with UPS. I have to say that it was much more of a relief than I had expected. After the initial fear immediately following the panel decision I became excited about my future and am now looking forward to a career change. I am going to the police academy in Januarary. I'm not sure if I will become a cop but the academy is just something I've always wanted to do. I will probably continue my education following completion of the academy.

On a side note, after being terminated and getting on unemployment I was able to gain more custody of my four year old son. I realize that I am very lucky to have a new wife that makes enough money to support our family and I'm really enjoying my time being a stay at home dad for the time being.

I want to wish everyone out there the best of luck! Especially the drivers, keep your head up and please stay safe. FAMILY FIRST!!!!

After 13 years with the company, 7 on road I was escorted from UPS property and had my badge confiscated. I have been the squeeky wheel in my center filing grievances and making coplaints for harassment for awhile now. Needless to say I have been a lightning rod for retaliation and hostility from multiple center managers. I have recieved countless discharge letters none of which have ever been heard at panel. Even though my numbers have ALWAYS been stellar (more often than not I run scratch on routes) and have an excellent customer service history I have a reputation amongst management as being a problem. hey lighting if you didnt have a rep in there with you , you made a mistake

My current center manager is extra tallented at creating a hostile work enviroment. I explained to her that I felt unsafe and threatened in the work enviroment due to her constant harassment and threats. I explained that if there was an issue that she needed to address with me I would require that a shop stewart be pressent at all times. I then said that I felt it necesary to record any such meetings.

The following morning I was brought into the office. I advised everybody in the room that I intended to record the hearring. My center manager than told me that it is illegal to do so and that she was going to press charges. I replied that it is not illegal and I refused to take part in the hearring without it. She instructed me to turn it off three times and I refused. I was immediately fired and escorted from company property.

My intent in recording the conversation was to try and minumize her hostility towards me. Also to have something to refer back to in case there was something that I had missed.

My BA told me we will have a pre panel hearring in about two weeks an then a formal panel hearring sometime in September. Meanwhile I'm trying to gather information and advice going into the panel hearrings. Any info or help would be greatfully appreciated.

The previous day I was asked to help another driver across town. I messaged that I did not have enough fuel, was instructed to help anyway. Contacted my on car supe and told him I didnt mind helping but did not feel comfortable driving on an empty tank. He advised that he would send someone to pick me up and transport me to the driver that needed help, I agreed. He called me 15 minutes later and told me to dissreegard and return to hub. Center manager pulled me in the following morning to harass, later stated to my BA that she did not intend to take disciplinary action just to talk about the issue.
There were three unresolved grievances that I had filed against the center manager for harassment within a week of my being fired.

Well if you become a cop? And if you want to you can all the revenge you want? When I was on my 90 day period. one guy get fired. That guy became highway patrol officer. Rumor has it 2 years down the road. The guy pulled over center manager for DWI, and through the book at him. Resisting arrest, assault of law enforcement officer, because the center manager supposedly pushed the officer when officer was doing soberity test. Good luck in the Academy.

when you were instructed not to use the recording device and you continued to do it...Did the center manager go through progressive discipline with you? for example when you refused the first time did she say you would receive a warning letter...followed by a suspension after your second refusal?... COntractually I do not see this as a cardinal infraction...but if that progressive discipline happened you may be done....On the other hand, arbitrators usually lean toward a principle that gross insubordination in an employee / employer relationship results in choas that prohibits the employer from accomplishing their objectives...NOt sure this rises to that measure but with an arbitrator your whole file is on trial.

I have seen similar things like this happen here too. We had a p/t sup(nice guy)get fired for defending himself against an overzealous employee wanting to kick his butt. Long story short both got fired and said p/t went on to work at the local p/d.
