He had the laptop and could see the message headers but he couldn't legally use any of the content without a warrant. Probably FBI agents did read them in the Weiner investigation but they needed another warrant to be able to use them for the Hillary investigation.
And the reason he didn't have a warrant earlier was the Justice Dept tried to block it. Might have been the reason he needed to go public about it when he did.
