Interesting...in my state they draw blood to confirm the breathalyzer in all dui cases. Because without the blood test, the charges often times will not hold up in court.

A good lawyer should have a field day getting your charges dismissed on breathalyzer alone - they're not terribly accurate, and because of that, there's plenty of precedent of cases being tossed out for relying on them alone. A blood test, along with a field sobriety and breathalyzer, makes for an ironclad open and shut case. Which is probably why they're a requirement in my area.

But I guess it's not that way everywhere apparently. I was wrong to assume it was.
They have dash cam video 99% of the time showing you are failing roadside sobriety. They generally do that before even asking you to take a breathalyzer. So even if you refuse to blow it's hard to deny it.

In my state, a blood draw is not required.


They can use a portable Breathalyzer, field sobriety, and officer testimony as

probable cause to arrest. Then at the station, they can have you take a confirmation

Breathalyzer by a state certified technician on a state certified machine.


Best thing to do.... is refuse any tests and keep your mouth shut.

It can be an automatic 1 year suspension of your drivers license.

(that's what the police will threaten you with, if you refuse)

But, when you get to court you can always plead guilty.... and then it's

only 6 months with driving privileges.


That's what all the judges, lawyers, and cops do when they get popped.

You get one freebie here to deny the breathalyzer that's it. Second time(if you happen to be that stupid)automatic 1 year suspension. CDL you can not refuse,but if you do automatic 1 year suspension.

Those Thirsty Thursday nights out were EPIC. Not proud of it but I remember one day hiding in an alley puking my guts out from the night before. I shut the bars down many Thursday nights and then met the wives after work on Friday to do it all over again. We were bullet proof.
It was 2 to 4 nights a week for us.
We didn't drink with Management though.
Not having a hangover when punching in the next morning was rare in the 80s and early 90s

Guys coming in Friday mornings half loaded was as common as guys having sex in the back of their
package cars or on the route. Honestly, both were common in the 70's and 80's.

I thought the same thing but didn't say anything because I was hoping she meant their personal cars not UPS trucks.

Because if she means UPS trucks then yeah I have to say BS
You'd have to ask some ol timers from the 80's if they are still around. this was at the Willows satelite center in Cali. yes. it was package cars that they parked at the bar. i really don't care .

we use to have a rural driver show up with booze breath all the time ,I heard he finally got popped . 80s and 90s showing up hang over still a little drunk happened a lot .Now the pace is gunning and running to the point they need a IV to keep going .

I read four pages. I dont know. No alcohol in blood is good. Should have called off. Thats what I would do, but then on a work night I wouldnt do it in 2000 +.

very small town. lived there for awhile until the center closed. the satelite center was just set up for feeders and some package back a long time ago when California was thinking of allowing triples on the Interstate 5 corridor.

it never came to pass so the company closed it along with a bunch of other centers around 1996-97. about 17 of us drivers were scattered all over. some went to sacramento , some cordelia, one went to oregon , i think one went to redding, and a couple guys retired. it was a mess.

kinda glad it did close looking back . the town of willows is in the middle of nowhere. it does have a wal-mart but that's about it.

was off on my birthday and had a steak and a couple beers. supe called me to handle run that another driver called off on. told supe I could not do it. he pleaded and then begged and then threatened. told him no. he said he would have to do it. ( was a feeder trainer ) if i didn't. I said sorry and I was not going to risk my million dollar cdl . man was he pissed.

if he couldn't understand that .......... well actually not surprised since he was a UPS manager......
