The Irony of the Special MAtser that tRump demanded ( and is being billed $500 an hour for the services) isn't putting up with the lunacy and BS that tRump loves to spout. Judge Dearie doesn't buy the fact that tRump declassified the documents as his lawyers wont testify under oath that he indeed declassified them. I wish his lawyers would quote tRump's statement that the President can declassify them just by thinking about it

The special master appointed to review documents federal agents seized at former President Donald Trump's Florida estate appeared doubtful Tuesday about Trump's contention that he had declassified the various top secret and other highly sensitive documents found there.

The special master, Senior U.S. District Judge Raymond J. Dearie of New York, had asked Trump's attorneys for more information about which of the over 100 sensitive documents federal agents found at his Mar-a-Lago estate in Palm Beach might have been declassified. Trump's attorneys had told the judge in a letter Monday night that they didn't want to disclose the information yet because it could force them to prematurely "disclose a defense to the merits of any subsequent indictment."


At a hearing in federal court in Brooklyn, Dearie noted that the case is a civil dispute, not a criminal one, but said he was taking the government's concerns about national security seriously.

"Let's not belittle the fact that we are dealing with at least potentially legitimately classified information. The government has a very strong obligation, as do all of us, to see to it that that information doesn't get in the wrong hands," said Dearie, a former judge on the Foreign Intelligence Surveillance Court whom President Ronald Reagan appointed to the New York federal court."

While Trump's filing claimed neither side had provided a showing that the documents are classified, Dearie said the government had presented "prima facie evidence" that the documents are, because they bear classification markings.

"As far as I'm concerned, that's the end of it," Dearie said, unless Trump's team has some evidence to the contrary.

Trump has claimed on social media that he declassified all the records he had, but his lawyers have yet to formally make that argument in any sworn court filings.

AS the 11th US Court of Appeals pointed out, the issue is whether the documents were declassified or not is in their words a "red herring" because the documents themselves do not belong to Donald J Trump.
the problem with this argument by a supposedly unbiased court is they have not themselves reviewed each document , nor listened to arguments as to ownership. They have thus decided to listen to one side the DOJ to make that determination.
ownership of said documents would still have to be at the time of initial possession.
The DOJ or intelligence community can claim ownership or even reclassify those documents post presidency but at the time of initial possession those documents were acquired and possessed by a sitting president of the united states.
As such the process once that Potus leaves office is the determination of ownership which in the past has always been an amicable negotiation that in Obama's case has still not been resolved but did not require an armed raid.
in this case since it is Trump and the current administration needed a distraction away from their miserable performance results they went to the extreme of turning those negotiations into an armed inssurection of a former president to try to deny him rights that were clearly spelled out during the time of nixon and beyond specifically for former presidents.

What the 11th US Circuit Court of Appeals had to say in no uncertain terms isn't garbage. In fact 2 of the 3 judges assigned to hear the appeal were Trump appointees and the 3 where unanimous in their decision siding with the DOJ.

This leaves it up to Trump to decide which fire he started does he want to try to extinguish first. New York, Georgia, Florida or DC.
there is a lot of confusion on what is and what can be that even confuses trump appointees. No case like this has ever been heard.

but i promise you this your party has opened up a pandora's box that will affect future presidents including Biden and his crime family.
