Yes, the problem, the BIG problem, is that FedEx is in the group of companies covered by the "Railway Labor Act", while UPS is properly covered, instead, by the "National Labor Relations Act".
Well, the problem is actually the Republican'ts in Congress who refuse to make the UPS--FedEx ballgame fair and square by putting FedEx under the NLRA.
