I think the VP does have the power to send votes back to the states, all the arguments I've seen against it are pretty weak "lol no ofc you can't do that, because!!!"
Meanwhile the 1887 Electoral Act seems vague enough to hold up if a VP pushed the issue
I don't think that SHOULD be the case, I think if Pence had overturned the election things would have gone bad for the country, but I DO think the authority was there enough to be considered legal
