What do you think is.... the first question you will be asked.... when sitting in front of a panel ?

"Did you file a grievance protesting that ?"


OR.... You could be a man, and accept responsibility when the fault is yours.

I don't see how you could look your center manager in the eye as you handed him the grievance.


Or.... you could ask the center manager.... if you could wash their car.... on the weekend.

Impossible with a truck you can not even walk through and all industrial stops at 1:00 PM. And here comes an air driver with the LIBs that would not fit. Have a lot of drivers looking at feeders right now.

Not impossible. You have to stand up for yourself. If that's impossible for you or your co-workers, then, yeah, it's impossible.

Walk in the office. Apologize and say it won't happen again. Everything ends right there.
 
Believe it or not there's some mgmt still out there who'll just pull you aside and tell you not to friend' up again. Grieve on those guys and they will write you up so you have something to file the grievance on.

Boil it down and ultimately no matter what the driver is the one responsible for remembering to get that break in.

THE FINE IS $2,750.00 FOR THE DRIVER AND UP TO $11,000.00 FOR THE COMPANY....PER OCCURRENCE...PER DRIVER THAT BREAKS THE LAW (if caught by the DOT). NOT $1000.00.

The answer is in your post "....up to $11,000". It has to start somewhere (hint, $1000) in order to go up.

how in the world is this your problem? take your lunch at a decent time.... call the center and let them figure it out

The MAX fines apply if you violate driving hours by more than 3 hours. Violate by one minute and fines can be administered.

Companies and drivers that commit egregious violations of the rule could face the maximum penalties for each offense. Trucking companies and passenger carriers that allow drivers to exceed driving limits by more than three hours could be fined $11,000 per offense, and the drivers themselves could face civil penalties of up to $2,750 for each offense.

Driving (or allowing a driver to drive) more than 3 hours beyond the driving-time limit may be considered an egregious violation and subject to the maximum civil penalties. Also applies to passenger-carrying drivers.
