Workers Comp and Retro Check Question

    I’m currently out on disability for a work related injury. I’ve exhausted the comp portion at 72%, and have now moved on to temporary disability which is paid at 66.67% of my average wage over the past 12 months from the date of injury. Now that we’ll be receiving retro checks and i’m in my third year of progression would it be possible to have my disability pay re-evaluated to include these wages in the calculation as they were earned in the 12 months prior to the injury, but paid out at a later date. It would be close to an additional $250 I would be bringing home monthly. Any help would be appreciated.

    I would contact the state, or whom ever pays your disability as that is who ultimately would know.
