I come to work every day at 1630 and leave around 0400 or so ( everyday )

The car was towed at 2030 ( 4 hrs after I started my shift )

Update " The problem is still being worked on between me, the union and the center manager.

hint: very aggravating
Send it to Judge Judy!! lol :surprised:

My opinion is that UPS is liable to you for ANY result of their actions and the towing company is liable to UPS for any consequences to UPS of towing company neglegence. That is to say, you need only sue UPS and it's up to UPS to sue the towing company if UPS has to pay you off. But like everyone else on this thread, my opinion is worth what you pay for it. Better, read this: http://www.leg.state.nv.us/Nrs/NRS-487.html

I found out yesterday from 3 credible people including an actual LP person that it was a Manager that had to sign the authorization for LP to tow the car .

They told me the managers name and it was the same person who brought me to the tow yard and payed the bill.

All he had to do is tell me "hey, I screwed up man. i didn't know it was your car and came to a conclusion that it was abandoned/"

It's been 7 days and no one has approached me from management or LP to apologize. I want formal letters of apology for my wife from from both LP and the manager.

It's all about CYA ing and denying blame and it has even been brought up to me twice that there is a question in their minds whether the 4WD was working before the tow.

Everyone told me this was gonna happen.

I'm really disappointed in the manager who signed the authorization because I have a good repore ( sp? ) with him and the center manager because he is known to be a stand up guy. And I believe he is also. Known him for 15 years and he has always been right with me,

You've known a guy for 15 years, and he doesn't know what kind of car you drive? What, are you the invisible man?

we have about a 1000 people at our hub so I'm sure he can't know everyone's car.

a apology is an emission of quilt in the eyes of the law. If get in an accident and say your sorry you are admitting guilt.

If you do take this to court you will have to sue both parties involved. If you don't they will just point the finger at the other. they will have to pay weather your 4 wheel drive was or was not working. Its the same as if you rear end someone that already had some damage to rear. You now own all the rear damage.

If you pursue this, you may win. But, it could turn into a costly victory because I fear that you will have also painted a bull's-eye between your shoulder blades. I'm just saying.........................

You know, you are driving an unsafe car to work each day. It seems to me you ought to rent a car until UPS/the tow company decides to do what is right. And have them send the bill for the rental to Uncle Brown. After all, it is because of his actions you are without transportation.

I would bet that the dragging of feet will stop pretty quick when you ask to put the car rental on the sups credit card.

OP…………….

No one giving you advice on this board (including me!) is a lawyer. This situation is going to drag out (as you’ve already found out), call a lawyer. Calling a lawyer will get you real answers to what your rights are in this situation.

I was already told by the union that I could get a rental car. I would really like limo service to and from work. If not that, then the penthouse suite at one of the area casinos with a couple hookers thrown in.

Actually, the car drives fine as is. It's one of those old Subies with the lever in between the seats to engage the 4WD. I did have to buy chains for it though.
