UPS Towed My Car From Employee Parking Lot

I was already told by the union that I could get a rental car. I would really like limo service to and from work. If not that, then the penthouse suite at one of the area casinos with a couple hookers thrown in.

Actually, the car drives fine as is. It's one of those old Subies with the lever in between the seats to engage the 4WD. I did have to buy chains for it though.

OP

And your reason for this thread? You just lost the case, imho. The car either needs repairs or it doesn't.

I think you misunderstood or I stated it wrong. A poster said I was driving an unsafe vehicle.

The 4WD worked on the day I drove it to work. After they towed it, the 4WD did not work but that does not make it unsafe. I can manually disengage the 4WD with a lever between the seats.

Therefore , I only have 2WD. Last Sunday I had to buy a set of chains for it to drive in bad weather.

It still has to be repaired to make it the way it was before it was towed so I can use the 4WD.

If you pursue this, you may win. But, it could turn into a costly victory because I fear that you will have also painted a bull's-eye between your shoulder blades. I'm just saying.........................

Isn't this something? So maybe I should just eat it to stay on their good side?

What if it had been your car?

Don't get me wrong, I know exactly what you saying. the bull's eye has been on me off and on for the last 15 years.

I'm kinda use to it.

danny , in a court case, ups and/or towing company would be the defendant(s) and the burden of proof would be on the plaintiff, so ups would not have to prove he had not taken care of the car, but plantiff(orangeputeh) would have to prove that the actions taken damaged his 4 wheel drive.
Wrong,
The plaintiff was already wronged, by admission of evidence.
The vehicle was legally parked, by an employee.
The vehicle was legally road worthy.
UPS, wrongly, had the plaintiff's vehicle towed, admitted by paying the towing bill.
The burden of proof, they illegally had towed, lies squarely on the shoulders of UPS and the towing company.
He drove the legal car into the parking lot, ergo, it was a functional vehicle before it was towed.
UPS only has the defense of argumentum ad ignorantiam.

let me be a legal poindexterus here and take issue with sentence #6, he is still driving same vehicle into the parking lot(after towing incident) , so by your definition it is still a functional vehicle.

Satellite driver, In my posting that you quoted, I was referring to him proving that the actions taken damaged his four wheel drive, not proving that it was illegally towed. If you agree with the previous sentence and posted as such in response to my quote, then he can also claim that the rip in the seat wasn't there before incident, that he had a hubcap on back rear tire and now he doesn't have one there, that the crack in his windshield wasn't there until afterwards , etc, etc, etc, ad infinitum

You know things are about to get out of hand, when people start slamming each other in latin.

You're right, 9/5, I was thinking that he had AWD, and that the car wasn't working anymore. My bad!

steven, yes it is true while some latin words and phrases were used, "poindexterus" is not latin word but just a tribute to poindexter, our brilliant friend from Felix the cat. (now go be a good boy and fetch and post his picture in your next posting)

This is becoming a nightmare for us. Today I had to call in sick bc i couldn't even get it the car out of the driveway to go to a shop. ( It's popping in and out of gear and making a slight grinding noise )

Finally after about 4 hrs got it to a shop. "Too busy to look at it ." try Wednesday"

Went to another shop . " Too busy , bring it back thursday. "

Went to a third shop at they were closed early.

Have no other car for the 40 mile commute. Now am I gonna have to really get a rental car? Co. already mad at me. Still don't know why.

Hitch-hike with the UPS uniform on?

Been trying to borrow a car but everyone I know is working or looking for work.

I just can't believe that a little stupidity ( LP , et al ) goes a long, long way.

Sorry for the whining.

This is a shame that UPS managers and supervisors are not kept in check. As in most cases, were are only as good as our weakest employee. This should have been caught by management. Seems like someone had too much time on their hands.

Also, you can get an attory to write a letter requesting the cost of repairs before you have to acutally file the claim. This is less expensive, and effective in getting some sort of action going.

No need to apologize, but let's pretend that ups had nothing to do with this for the moment. At some point your car was going to go , what were your backup plans for when your car is disabled? (Everyone here has a backup plan to get to work if your car doesn't cooperate for whatever reason, right?)
