Well, I was there from 10 to 1530, nonstop. Half of the tests they gave me had nothing to do with our job. I assembled and disassembled nut and bolts for about 20 minutes. I had to crawl on all fours across the room and back, and things that we just don't do. They monitor your heart rate and ask you what your pain is on a scale of 1 to 10 for everything.

Long story short, I left not knowing anything more than when I walked in. Apparently it's all based on the data that is entered into a program from the test. I assume Liberty Mutual gets the results before I do. I guess now I just sit around and wait for someone to call or email me? The whole thing is nuts. I asked everyone I knew involved with medicine, UPS, the union and so on. No one was able to tell me anything. I got the most information from here, but unfortunately it sounds like every state is different, and obviously not everyone here that has been through it had the same experience.
Has the dr sent you back to work

Does ur ankle hurt? Does the result of broken ankle prohibit you from doing anything before u broke it???

Were you standing during nuts and bolts test?

Yes. I have been back to work full-time since the week after Christmas. Yes, my ankle hurts. I don't think it prevents me from doing anything at work, it just makes it more difficult and painful. Yes, I did the nuts and bolts test several different ways, including standing, sitting, kneeling, and squatting.

I have not heard a word from anyone about anything as of this moment. The injury has definitely had an impact on my life and job. If they conclude otherwise, I think there's going to be some issues on my end.

I see..then I assume the dr who performed the impairment rating on you will will asign a number representing what he determines is ur impairment. It will probably take a week or two. You should call ur adjuster at liberty mutual for updates. You are still guaranteed treatment on ur ankle for life. You can search impairment ratings in ur state via Internet to understand how it's payed and the amounts per rating

You can also appeal the rating through ur treating doctor if you and the dr disagree. Or by calling workers comp in ur area to get free help

I agree it can be very confusing going through it the first time. My advice is to calm down, let it run its course. It's just an impairment rating and monetary reward which is mandated through workers comp in ur state.

Well, I'm back. I was scheduled to have my impairment reading and the functional capacity test this morning at 8, and in typical fashion, they are not prepared for it and pushed the appointment back a few hours.

My question is for those that have been through this, when do they actually offer you the settlement? I was under the impression that Liberty Mutual was attending this appointment, but they are not. I do not want to take another day off without pay to deal with that aspect of it. Do they contact you by phone with an offer, or do they expect you to take another day off to have some sort of mediation?

Ok, here is an update on my situation. After 2 weeks, I contacted Liberty Mutual, because I had not heard a word after testing for 5.5 straight hours. In a brief conversation with the claims specialist, she said they valued my disability at around $11.00, which according to state law is multiplied by 425 weeks. This leaves me with a settlement of roughly $4500, which she said will be paid in weekly installments.

This is FAR lower than I was expecting, and I have decided that I will not accept it if I am to give up anything at all- and most likely not accept it even if I give up nothing . The fact that they won't even pay it in a lump sum is just a kick in the nuts. IIRC, from what I read about stat law, even a 1% impairment rating would be my weekly income x .065 x 425 weeks. They are sending me the paperwork to review, and she talked like it was a foregone conclusion that I would accept this settlement.

Settlement or money for impairment? You are using different terms which have nothing to do with the other.

Lol. Are you still working? So they won't give you as much as you hoped fast enough? Won't accept their offer? It's not an offer, it's monetary benefit for being slightly impaired.

Dr.'s here give you your impairment rating and it's based on a scale set by the state.Take the money it's all you're going to get,keep your case open under whatever the laws are required in your state and when you leave UPS they will likely settle it with you pending any future treatment and cutting their ties with you.

There is NO CHANCE I would be having any conversation with the company, and especially Liberty Mutual without an attorney, regarding an injury. Insurance companies aren't profitable because they are fair. It's their job to pay as little as possible, and it's your job to get an attorney that can get you as much money as they can.

He's getting an MMI impairment rating payout you really don't need an attorney for that.

So, last year I broke my ankle on the job. I was out from August through Christmas.

I got a call today from Liberty Mutual telling me that I have the option to schedule a "Limitation hearing" (i think it's called).

Basically they will be offering me a settlement to not claim this injury again. I have no idea what to expect, so any advice you all could share would be great. Thanks

Omg it's an impairment rating governed by the state. I've had two.

Many years ago, I crushed one of my thumbs with a dolly. Broke the bones into 7 or 8 pieces. Seems like I was off work 2-3 months. I got an impairment rating of 1%. i said I don't agree with it, since the doctor who gave me the rating was the same one that did the surgery. I told LM that that was a conflict of interest, since he's not going to give his work a bad rating. They sent me to another doctor (one picked by the state) I knew I was in trouble when this doctor commented how good a job the initial doctor did on my thumb. After several hours of tests, measurements, etc. This doctor ended up giving me a 3% impairment. All decisions on this rating is final. Back then, each % point was around 1k. I always felt like I got taken advantage of because I didn't know any better. I'd contact a lawyer as well if I were you.
