Your PT sup, area coordinator or building manager do not have the right (nor training) to make the determination that you will NEED to complete UPS' substance abuse program. If they have been trained in observing behavior that may indicate intoxication, or if you openly told them you are using a controlled substance they may have the obligation to have you speak with a SAP specialist. SAP will make the determination of whether you need to go through the program. ABSOLUTELY have a steward or BA present when you have ANY discussion of this. If UPS tries to discuss it with you alone, demand representation - tell them you want to utilize your Weingarten Rights. Good luck with everything - stay strong, brother.

Is it grounds for filing a grievance if they refuse to let me work Monday morning? One of the sups said that I couldn't work till i complete a treatment program. I don't get how after this long they can act like this.

Edit* it would be different if i was on something illegal or if I was walking around stoned.

You need to file a grievance if they did not let you work today. You need to have the Union involved.

You may not necessarily have to do their treatment program, but you also may not be able to work while on methadone.

Even with a script, the issue is methadone.

Article 35 Section 3.17 of the NMUPSA

b. Review the employee’s medical history and relevant biomedical factors. A driver is allowed to use a controlled substance (except for methadone) only when taken as prescribed by a licensed medical practitioner who is familiar with the driver’s medical history and assigned duties.

I know it says driver, but we have lost grievances for non drivers being on methadone under this language.
