It’s so great but he needs to switch contractors and he only works weekends when he wants to but the wife is a surgeon probably a brain surgeon, but he needs time off to collect his Nobel peace prize.

Or a tree surgeon. Nothing about it made sense. After what his wife had to go through to become a board certified surgeon even just a general surgeon do you really think that she would put up with guy who seems to have little clear direction to his life. Says he makes $1200 a week. Perhaps he grosses $1200 a week if he runs 6 days.

Former employer would have to prove exactly HOW he was being competed against, as well as prove any economic harm.

In other words, he would be making a fool of himself to litigate.
In some areas, a non-compete clause is only good for professional positions where special skills or training are required. A non-compete clause may work against you becoming a contractor competing with hi, but in any reasonable state, you shouldn't have a problem. If you are in Texas, Oklahoma, and a few other states run for/by the wealthy with 'good ol boy' networks in control, you may have a problem. Those states consider themselves as 'business friendly' while most might call them 'anti-worker' when it comes to labor law.

I've worked for 6 single route contractors as a swing, a multi for 6 yrs, another multi for 2, and another for 5.
I've relocated in the last quarter and it was the easiest job I ever applied for. I did my homework when I moved, I have full benefits other than pension. 80% healthcare paid for and full dental, vision, and a life policy.
