A New York federal judge on Tuesday declined to dismiss a proposed religious discrimination class action the U.S. Equal Employment Opportunity Commission brought against UPS over its appearance policy for employees but said some claims are time-barred.

United Parcel Service Inc.(NYSE: UPS) is seeking incentives from Miami-Dade County in Florida to build a $65 million facility in the northwest part of the county.
“Project Ideal” is keeping its identity confidential as its application under the Targeted Job Incentive Fund was filed with the Beacon Council, an economic development agency in Miami. The county commission will vote on the item on July 19.
United Parcel Service fired an employee at its Maumee distribution center after investigating an image posted on Facebook purporting to show a noose hanging inside the facility.
“UPS will not tolerate this demeaning workplace misconduct. The company has discharged the person responsible for this incident,” Susan Rosenberg, a company spokesman, said in a prepared statement Tuesday evening.

Family blames UPS for relative’s death
A family is suing a number of UPS entities, alleging their negligence caused a vehicle crash that killed a relative.
According to the complaint, on June 17, James Kaiser was a passenger in a vehicle owned and/or operated by Mike Smith Autoplex-German Imports and was traveling southbound on Cardinal Drive in Jefferson County. The suit says he was involved in a crash a UPS Cargo vehicle, operated by Paul Mouton, an employee of UPS, a crash that caused Kaiser’s death.
The plaintiffs allege the defendants failed to properly operate their vehicles in a safe and reasonable manner and failed to obey traffic rules and regulations.
