Are full time drivers paid lunch?

No way? We get 2 15 minute breaks and another 10 minute break after 10 hours. Crazy.

Here it's 2 paid 10's per 8 hours, and a 3rd paid 10 after 10 hours, with at least 30 min of unpaid lunch.

We don't distinguish between lunch and break. All is the same. 30-40 mins paid is sweet.

I would say yes, and yes. The contract has a provision that says it will be in compliance with state laws. I would verify this and then take the 2nd paid break.

i don't think it can be waived.

I'm pretty sure that if you have a signed waiver on file the second meal becomes optional, but I could be wrong. I have never taken a second meal free working over 12 hours and never got any flak for it

Should I call state labor dept directly and bypass the union?

I agree with you state law should trump contract, but I am just a dumb truck driver what I know.

I have not read the law you are talking about, but apparently your local is saying that the 10 min break and 50 min meal satisfies the law.

If it did not satisfy the law, they would have won.

Does the law say a "paid" break every 4 hours or just entitled to a break every 4 hours?
