OK. But are there stipulations in the law that nullify the paid 10 minute break if you are being paid time and a half?

Kentucky law states time and a half after 40 hours. UPS pays time and a half after 8.

You get a 10 minute paid break for the first 4 hours. You should get a 10 minute break after the next 4, after 8 hours of working. But now you are on OT. Does the law apply to OT?

Just throwing a possibility out there.

State law does trump contract. Your local has not won it yet because the attorneys seem to be saying that it satifies state law. They are not saying that state law does not apply.

Two different things.

There could be other legal issues at play also.

You need to get with the local and find the exact reason, not just that a 10 minute break and a 50 minute unpaid lunch are good enough to satisfy the law. You to find out why it supposedly satisfies the law.

337.365 Rest periods for employees.

No employer shall require any employee to work without a rest period of at least ten (10) minutes during each four (4) hours worked, except those employees who are under the Federal Railway Labor Act. This shall be in addition to the regularly scheduled lunch period. No reduction in compensation shall be made for hourly or salaried employees.
