EAM Driver 22.4

If there where drivers with hours available, claiming that we offered it to them and "they said no", does not validate an air driver doing full time ground work.
I remember trying to file that same grievance. Union rep showed me the contract language allowing air drivers to deliver ground after exhausting all the other full time seniority lists.

Couldn't file a grievance for something that is contractually allowed

They didn't "exaust all means", if there were drivers with available hours?
We aren't allowed to refuse to work as directed by management, unless the directive is unsafe, dishonest, or illegal....and being directed to meet someone and deliver these stops doesn't qualify.

I don't know where I'm losing you guys....or am I talking with a bunch of air drivers who don't want to believe it?

Well i guess they will be fixing the "air driver delivering ground" issue with 22.4. Problem solved. :)

My mistake. It's in the national.

Section 1 - Air Drivers
(a) Air driver work shall consist of delivery and pickup of air pack-
ages which, because of time and customer commitments, cannot be
reasonably performed by regular package drivers. Such work may
include:
(1) Delivery of air packages which the regular delivery drivers can not deliver within guaranteed time commitments.
(2) Delivery of air packages arriving at the facility after regular
drivers have been dispatched.
(3) Delivery and pick up of air packages on weekends and holidays.
(4) On Call Air pickups.
(5) Pick up at air counters and drop boxes.
The Company shall not expand the utilization of part-time employees
to pick up drop boxes, including those containing ground packages.
The Company shall provide the International Teamsters Union with a
report no later than March 1, 2013 and, thereafter, an annual report by
August 15th of each year for the prior contract year identifying for
each Local Union the total number of drop boxes being picked up by
regular full-time package drivers, full-time air/combo drivers, and
part-time air drivers. The ratio of drop boxes picked up by regular full-
time package drivers, full-time air/combo drivers and part-time air
drivers shall be maintained (within two (2) percentage points) during
the term of this Agreement. Additional drop boxes will be picked up
by the same ratio of regular full-time drivers, full-time air/combo driv-
ers and part-time air drivers as established by the March 1, 2013
report. The size and dimensions of drop boxes existing on February
1, 2013, and those added thereafter, shall not be increased, without the
consent of the Union.
(6) Additional late air pickups.
(7) Air drivers may, on an exception basis, be used to make service
on packages which are not air packages.
An exception package is intended to be when an Air Driver is making
a pick up, as outlined above, after the regular driver has been at the
customer’s premises, and the customer has an exception ground pack-
age(s) for shipment, the air driver may make service on this pack-
age(s). Air drivers may continue to pick up Automatic Return Service
packages but the features of this service will not be expanded.
Any violation of Section 1(a) (7), shall obligate the Employer to pay
the Air Driver involved the difference between his/her rate of pay and the top regular package car driver wage rate existing at that
building. Grievances concerning violation or abuse of this shall be
referred directly to the National Air Committee.

I see no language in here that states options must be exhausted from ground drivers

That's Article 40 of the National Master.

Now, if you will, read the preamble to that article and tell us what it says???

In order for the Employer, the Union and the employees to further
benefit from the expanding air operations, the following Sections
shall supersede language on the same subjects in the Supplements,
Riders and Addenda, unless specifically stated otherwise in this
Article.

I've been doing this for a year and a half. Made more money last year than many drivers. There's no holes in this, at least not in my area.

Infact, currently I'm running pickups on Saturday. Top rate plus overtime for a 6th punch.

Work as directed until someone notices....

But do agree that Article 40 doesn't provide the Company the latitude to use you as they are???

They aren't doing it because they want to pay me to much to do easy work. They are doing it because the driver shortage is so extreme they are just trying to stop the boat from sinking.

I'm on first name basis with the stewards, BA, center managers, and the drivers know I'm just an air driver too. I've not heard of one instance of a grievance filed against ups due to me running ground.

What other work can I "say no" to?
I agree with you. In my area saying they aren't "allowed" to hire more drivers is what they claim gives them the right to do it. It's a crock.

Then paying grievances should be considered the cost of doing business???
I don't know everything but, I believe it's only happening because they can hide an air drivers hours from their boss. When grieved they claim that the penalty is the fact that they're paying the air driver top rate. No one agrees with that except the air driver but they're getting away with it.

It makes plenty of sense. Article 22.4 drivers don't get RPCD top rate for delivering or picking up ground, air drivers do. The way this company uses air drivers to cover their staffing problems, being able to give all the volume to a 22.4 instead will save them tons.
At our contract meeting our ba said the company wont save any money by using 22.4s.

Good thing he doesnt drive commercially or they'd be bloodtesting him after that statement.
