Repetitive Motion Injury Workmans Comp Claim

The only issue was not being able to specify an injury date; other than that, my mgt team was very supportive.

Did you fill any injury related paper work out for management in regards to this elbow before going to see the specialist?

Plenty of states let you start workman's comp with your own doctor.
I was under the assumption that some did not.

I am more focusing on the repetitive motion injury claim and the specialist basically bypassing UPS management and arguing his case for him to LM.

But what I have read about this way of arguing your injury cause is from the lawyers. They talk more about these type of claims then the state workmans comp language, my state said nothing about repetitive motion injuries!

What is your state law on occupational injuries? All our comp claims gets approved by the state.

I once filed a claim 8 months after I had surgery. Dr sent claim directly to ups’ 3rd party claims office. Ups was the last to know about it. Apparently ups had to pay 80K in fines.

I actually went to see my PCP because I had been experiencing tingling in the tips of my finger tips. He referred me to an ortho who diagnosed it as pinched ulnar nerves in both elbows. Everything up until that point had been on our medical insurance. He approved me for comp, which paid all of the bills that been paid up to that point, any new bills that came in and $400/week to me (total of $880).
880 for comp, that seems low. Suppose to be 2/3 of your pay at an average of 1 1/2 years. Sounds like they put you on personal disability to me but I could be wrong.

I would have figured you would have knee problems not elbow problems.

I'm sure it's be a very long time for you but the elbow is used a lot!

You just need to fill out a state injury form. State the truth. Call it an occupational condition that has occurred over time. Doctors will take care of you. There are issues if they diagnose you with arthritis tho. Just go to the biggest hospital/network you can find. Never go to "your" doctor or some small private doctor.. UPS can burry them in so much paperwork and legal :censored2: that you could get screwed. Huge hospitals have a whole floor of people to deal with insurance companies so doctors can spend their time fixing you.
