Should have anticipated the risk.
The simple fact of the matter is that if you drive for any X OPCO and something like this happens you are in fact guilty until you can somehow manage to prove yourself innocent. Happy for the X jock this was caught on tape. He was fortunate to have it to prove his innocence but there's no guarantee that even that will absolve him.

Legally: Not At Fault, other driver failed to yield.
FedEx will find it Preventable: Road condition, vehicle speed, driver inattention.
Based on total damages, driver may no longer be driving for FedEx. In that case, hopefully, he will find a non-driving position.

Can't tell from the video who had the right of way. Doesn't look like the FedEx driver had a stop sign (and my guess is that he didn't), but he could have. Could have been a traffic light. Either way, unless there was a good reason to expect otherwise, he should have seen the other car pulling out.

Let’s say hypothetically (since we know nothing) the FedEx courier had a green light and the car a red light. I’m guessing FedEx would still charge him with a preventable?

oh yes, as you know - if a meteor were to drop straight down outta the heavens directly on top of hapless driver’s van, CTV, whatever and he/she didn’t swerve to miss, it’s obvious someone wasn’t getting the big picture that day - and that individual needs to be held to account...........by cracky :angry:
