Local 104 refuses to cooperate with the Department of Labor

This past week agents from the Department of Labor paid a visit to Local 104. When DOL agent asked for principal officer Karla S she asked "who wants to know?" The agent flashed his badge and she replied "hold on just a second" and walked away. Her project Manager Dawn S came out of an office and informed the DOL agent that Karla S was not in the hall at the time and that they would have to contact the local's attorney(s) for further information.

As some may know, in March of 2016 the then principal officer Andy M refused to cooperate with agents from the Independent Investigative Office, so they issued a subpoena to retrieve bank and credit card statements. The DOL as of the past few weeks has been working with the IIO who has insisted a pattern of "embezzlement" exists at Local 104. Numerous sources from the DOL state they will issue a subpoena of every current and prior Executive Board member.

This is a dirty Local. The dues paying members of this Local should be up in arms and demanding answers immediately. The Dept of Labor does not play, they will get to the bottom of this. Oh yeah, hey uhm, A.M. just because you flaked out and moved away don't for one second think you are in the clear. Power to the Members!!

These whispered rumors are a joke. Last year we had a looooong meeting with a packed hall where we went over every budget item to the penny from the three summer months where we vote to not have GM meetings, and Andy addressed the investigation and how he ordered an independent audit. When that audit was complete the board went over it in detail with the members and the only thing that was changed was how money is handled in the Defense Fund (strike fund). Every penny was accounted for from when Andy took over the local, including all the supposed questioned credit cards. As expected, we have heard nothing regarding that supposed "investigation" and we never will. So much for the "pattern of embezzlement".

IF DOL agents stopped by the Local, (and two principal officers said this is "news to them"), referring them to the Union's attorneys would be the right move. Invoking rights to representation does not admit or assume guilt. i As with the Much Ado About Nothing IIO investigation announced over a year ago, this latest witch hunt will fade into oblivion.

The same one that hasn't been able to provide any members of the IIOs completed investigation in regards to this matter? No one steps down as principal officer of his local and JC to pursue a BA job in expensive California if he was squeaky clean, no one!

The IIO did not clear Andy M or 104 of this investigation. The investigation has been completed, however the IRO has not yet reviewed the IDOs recommendations. Luckily for the members the DOLs-Phoenix division which does not have much work at hand began its own investigation and the IIO is apparently cooperating with them. The IIO made it clear that 104 was not cleared of any wrongdoing to the DOL. The matter has not been solved do to greater problems with the IBTs General Executive Board.

Curious when the "DOL" started investigating local unions?

The DOL isn't a law abiding branch of our government. Wouldn't these "allegations" fall under the Department of Justice (DOJ)?

Nothing will come out of this. Explain to me/us those doing an investigation would risk any credibility to provide an internet site with any information.
