Sap program question

So this morning I was pulled into the office and told I had violated the terms of my SAP program and will likely be terminated. (Still waiting for official word) I have been in the random testing since February and since I entered the program have had no incidents and only clean tests. This weekend I drank on Sunday (off the clock obviously) I am also Tuesday through Saturday so wasn’t going to be working until Tuesday knowing drinking on Sunday would not show up on a test if I were to have a random. I made a few phone calls to coworkers who could tell I was drinking and were concerned for me therefore reported it to the center manager. Can they really fire me for drinking well off the clock and it having nothing to do with anything at work whatsoever? Thanks for your input in advance. I also realize I am in the program for a reason and shouldn’t be drinking in the first place however slip ups happen and I ask that you don’t give rude comments please.
I should also state I have contacted my union leadership and they feel it is not probable cause.

What terms of the program did you violate? Did you agree not to drink at all when you entered the program? The guys here aren't allowed to drink after 8 on work nights.

Yes I did admit to drinking as I have learned in the past when dealing with union/grievance issues that lying will likely lead to more trouble. It was actually kind of messed up as I basically was told by my center manager that I could resign and have a chance at returning to ups in the future starting all over or just be fired and never have a shot at coming back. To which then the union intervened and said no do not resign as that won’t solve anything and told me my best course of action was to grieve it.

There is nothing wrong with being honest.

It was actually kind of messed up as I basically was told by my center manager that I could resign and have a chance at returning to ups in the future starting all over or just be fired and never have a shot at coming back.

Center Managers routinely lie..... as they have no authority to make those claims.

To which then the union intervened and said no do not resign as that won’t solve anything and told me my best course of action was to grieve it.

If you don't grieve it.... you have no chance.

Listen to your Locals Unions advice.

I’d tell that center manager that I have 7 million dollars, a twelve inch schween, and routinely have threesomes with hot pornstars too. Then I’d say this is why I was drinking on Sunday and if he needs proof of any of this I’d say I don’t have any, does he?
 
I was called on Friday by my business agents stating that there is nothing they can do for me and that SAP was in the process of telling UPS to terminate me and expect a call on Monday to go sign your termination letter. Seems so messed up how something I did on my own time completely outside of work no crime committed or anything can cost me the job.

Article 35 is the largest article in the contract, and is very specific. It's all to comply with DOT standards.

The language is the same (verbatim) in the National Master Freight Agreement. Period.

C. "Ensure and confirm with the SAP that the employee demonstrates compliance with all conditions or requirements of a rehabilitation program in which he or she participated."



He was still in the program.... and violated the terms and conditions of his return to work agreement.

End of story.

But how did I violate it? Where is the proof? Again I said I drank. I didn’t say anything about what I drank. So therefore how did I not comply? Isn’t this country based on insufficient evidence? Or I thought it was supposed to be.

Didn’t see that he admitted it, that was dumb, although I also hope he receives the help he needs.
