Plaintiff Jerry Faidley worked as a delivery driver for defendant United Parcel Service of America (UPS). His doctor restricted his work activity after he hurt his back, and UPS did not offer him another full time position that he was able to perform. He sued for disability discrimination and retaliation. The district court granted summary judgment to UPS on all claims. Faidley appeals, and we affirm in part, reverse in part, and remand.

Appeals court revives former UPS driver’s disability bias lawsuit – Reuters

A federal appeals court on Tuesday revived a former United Parcel Service of America Inc driver’s disability discrimination lawsuit accusing the shipping giant of failing to accommodate his back and hip injuries.

n a 2-1 ruling, a panel of the 8th U.S. Circuit Court of Appeals reversed a ruling by a federal judge in Iowa that had thrown out Jerry Faidley’s bias claim, saying his fitness for a less strenuous job should have been decided by a jury.

UPS Lands Tax Incentives for Arlington Regional Hub – Commercial Property Executive

United Parcel Service Inc. will lease roughly 1 million square feet at the Arlington Commerce Center, which is expected to create 1,400 full-time jobs.

The Arlington City Council unanimously decided to grant United Parcel Service Inc. tax incentives for its new regional hub, scheduled to open in 2019. The company will lease one of the city’s largest industrial spaces, now under construction—roughly 1 million square feet at the Arlington Commerce Center—and expand it by 200,000 square feet.
