According to the FMCSA they can not do anything to you:

6.3.1 Illness or Fatigue (392.3)​

Drivers may not operate, nor shall a motor carrier require or permit a driver to operate, a CMV if they are too tired or sick to drive safely. Operation may be discontinued at the driver’s discretion. In the case of a grave emergency, where danger to the driver, occupants, or other users on the road would increase if the driver stopped operating the CMV, the driver may continue until the nearest place the danger can be eliminated.

If you don’t have sick of personal days, what’s the progressive Discipline for calling in. Can it lead to an off the clock termination?
You get 7 occurrences outside of your option days before discipline can (should) start. You should know the steps of progressive discipline; verbal, written, suspension, termination.

Be careful using fatigue too much. Guys use it here in feeders all the time but a little trick they like to play is if you use it to much they send you for a medical evaluation and they tell the Dr to put you thru the ringer. Cpap machine to see if you have a sleeping disorder.

go to a doctor and say you get headaches. Ask for FMLA paperwork. There, you now have unlimited call ins. Almost every new driver in my building has done this and work 3-4 days a week now
